Priority dates, continuation strategy, and why filing order matters

A priority date affects which references may qualify as prior art, while continuation practice can preserve that date for supported claims. Neither timing nor a later product launch resolves validity or infringement on its own.

A patent's effective filing date is an important part of determining which references may qualify as prior art. The analysis depends on the claim, the reference, applicable law, and the prosecution record; timing alone does not establish validity.

Rock Innovation's priority date is November 19, 2016.

Several modern cross-chain products launched after that date, including Arbitrum, Optimism, Polygon, and Wormhole. A later launch date does not by itself establish infringement or eliminate other validity questions.

Rock Innovation later pursued continuation applications based on the same family disclosure.

How to read this analysis

Technical similarities are starting points for review, not legal conclusions. A patent citation does not prove product use, materiality, validity, or infringement. Any product-specific conclusion requires current evidence, claim construction, and an element-by-element review by qualified patent counsel.

How continuations work

A continuation application can pursue new claims based on the parent disclosure. Whether a claim receives the benefit of an earlier filing date depends on support and other legal requirements, so the family relationship should not be treated as an automatic validity conclusion.

We used this mechanism deliberately. The parent patent, US 10,192,073, came first. Thirteen independent claim elements. Specific. It describes a system that flags discrepancies in blockchain data, replaces incorrect records, and logs the replacement. This is high-fidelity exception handling: the kind of reconciliation a bank or regulated entity needs when every data change must be documented and auditable.

A claim with more limitations is often narrower, but limitation count alone does not determine validity or strength. If a required flagging limitation is absent, that difference matters to an element-by-element review.

The first continuation, US 10,943,029, trimmed to ten elements. It dropped the addendum requirement but kept flagging. It added criteria-based retrieval: the system queries data sources using filters and only processes records matching specified parameters. This captures conditional logic, filtered queries, threshold-based triggers. The scope widened.

The second continuation, US 11,720,711, dropped to seven elements. No flagging requirement. No mandatory criteria filtering from external devices. The independent claims describe a system that interfaces with blockchains, retrieves data, applies rules, and stores the output. That is the entire claim. Seven elements.

Why seven elements matters

A claim with fewer limitations may be broader, but infringement still requires proof of every limitation and scope depends on claim construction. Counting limitations is only a starting point.

The continuation claims use different combinations of limitations while relying on the family disclosure. Each patent and each asserted claim must be evaluated on its own record.

The strategic result

The three patents claim priority through the November 19, 2016 family and contain different limitation sets.

The '073 includes detailed flagging and correction limitations. The '029 includes criteria-based retrieval language. The '711 uses a different seven-limitation structure. Those differences determine which evidence matters for a particular review.

A licensing discussion should start with the specific product version, the asserted claim, and an element-by-element comparison rather than a sector label.

All three patents are in force. Issuance does not remove the need to review their prosecution histories, claim construction, validity questions, and the facts of a specific implementation.
